Any party that loses a hearing at the Division of Workers' Compensation
has the right to appeal that decision. The first appeal is to an Appeals Panel at the Division. The next appeal
is to the courthouse where the case can be litigated to a jury.
There are many instances when the insurance
carrier appeals a decision to the courthouse and the injured worker can't find an attorney to help them. There are
not many attorneys in North Texas that will handle a workers' comp case in a jury trial. Some claimants don't
even look for an attorney because they think they can't afford one. But when the insurance carrier sues injured
workers to appeal a decision of the DWC, injured workers can have the attorney fees paid by the insurance carrier.
If an insurance carrier sues you to appeal a DWC decision, don't delay. Get to an attorney immediately.
